  • Fines: Between $500 and $1,000 (or up to $2,000 with aggravating factors).
  • License Suspension: 180 days to one year.
  • Jail Time: Up to 6 months.
  • Probation: Up to 12 months.
  • Community Service: Minimum of 50 hours.
  • Vehicle Impoundment: 10 days.


Repeat DUI Offenses


Penalties become significantly harsher with repeat offenses:

  • Second Conviction: Possible jail time up to 9 months, increased fines, ignition interlock device for at least one year, and longer license suspensions.
  • Third Conviction: If it occurs within 10 years of a prior offense, it's a third-degree felony punishable by up to 5 years in prison.
  • Fourth or Subsequent Conviction: Always treated as a felony regardless of timing.
